DISTANCE SALES AGREEMENT

This agreement is established electronically between the Seller and the Buyer, whose details are provided below, under the terms and conditions specified below.

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts, concerning the sale and delivery of products whose qualities and sales prices are specified in the agreement, and which the Buyer has ordered electronically through the Seller's website erkugo.com.

3. PRODUCT / SERVICE INFORMATION

The type, quantity, brand/model, color, sales price, and payment information of the products are as stated on erkugo.com before and at the time of order, and are an integral part of this agreement.

4. GENERAL PROVISIONS

4.1. The Buyer acknowledges that they have been pre-informed about the basic characteristics, sales price, payment method, and delivery information of the product subject to the contract and that they have approved this information electronically.

4.2. The Seller agrees to deliver the product subject to the contract completely, in accordance with the qualities specified in the order, and in compliance with legal regulations.

4.3. The product will be delivered within the specified period, not exceeding the legal 30 (thirty) day period, depending on the Buyer's residence and the chosen cargo company.

4.4. The Seller does not accept responsibility if the Buyer is not present at their address during the delivery of the product.

5. RIGHT OF WITHDRAWAL

5.1. The Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the product, without stating any reason and without paying any penalty.

5.2. To exercise the right of withdrawal, it is sufficient to send an email or written notification to the Seller within this period.

5.3. The product to be returned under the right of withdrawal must be unused, its packaging undamaged, and in a resalable condition.

5.4. Unless otherwise specified, the return shipping cost under the right of withdrawal belongs to the Buyer.

6. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED

The right of withdrawal cannot be used for the following products:

• Products specially prepared in line with the Buyer's requests

• Products not suitable for return due to hygiene reasons

• Products with opened packaging that are not suitable for resale

7. RETURN AND REFUND

7.1. If the right of withdrawal is used properly, the product price will be refunded to the Buyer within 14 days after the product reaches the Seller.

7.2. The refund will be made using the payment method used by the Buyer.

8. FORCE MAJEURE

In cases of force majeure events beyond the control of the parties, such as natural disasters, war, strikes, infrastructure problems, the parties cannot be held responsible for their obligations.

9. AUTHORIZED COURT

In disputes arising from this agreement, Consumer Arbitration Committees or Consumer Courts at the Buyer's place of residence are authorized within the monetary limits announced by the T.R. Ministry of Trade.

10. EFFECTIVENESS

The Buyer is deemed to have accepted all terms of this agreement at the moment they place an order through the erkugo.com website.
This agreement has been established electronically and enters into force on the order date.
